The Drake Group Education Fund and its sister organization, The Drake Group, are proud to share a comprehensive, updated State-by-State NIL Legislation Database, organized by subject matter and each state’s law to make reviewing and comparing provisions easier.
This valuable resource was developed by Brooklyn Law School (BLS) student Chloe Theriault through the BLS Sports Law Clinic, under the direction of its founding Director, Professor Jodi S. Balsam.
What does the database reveal?
It documents current NIL laws in 32 states plus Washington, D.C., along with five pending bills across four states and executive orders in Louisiana and Oklahoma. Of the 32 states listed with current laws, 26 require athletes to disclose NIL contracts to their institutions, although the timing and procedures vary. These differences underscore why understanding the provisions in each state matters.
The database allows readers to compare effective dates, NIL contract disclosure requirements, institutional and team contract conflicts, compensation provisions, professional representation, and tax and athlete employment provisions.
View the attached database to explore how states are addressing these critical issues. We encourage you to share this resource with colleagues, college athletes, educators, and others following the future of college athletics.
